"Platform" refers to ResLinQ website, mobile applications, and related services
"Student" refers to users seeking accommodation through the Platform
"Landlord" refers to users offering accommodation through the Platform
"Content" includes all information, text, images, data, and materials on the Platform
"Services" refers to all services provided by ResLinQ
"Agreement" refers to these Terms and Conditions
3. User Accounts and Registration
3.1 Eligibility
You must be at least 18 years old to use the Platform
You must provide accurate, current, and complete information during registration
You must maintain and promptly update your registration information
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account
You must immediately notify ResLinQ of any unauthorized use of your account
3.3 Account Types
Student Accounts: For individuals seeking student accommodation
Landlord Accounts: For property owners/managers offering accommodation
Institutional Accounts: For educational institutions partnering with ResLinQ
3.4 Account Suspension and Termination
We reserve the right to:
- Suspend or terminate accounts for violations of these terms
- Remove content that violates our policies
- Ban users who engage in fraudulent activities
- Limit access to features for any user at our discretion
4. Services Provided
4.1 Platform Nature
ResLinQ acts solely as an intermediary platform that:
- Connects students with accommodation providers
- Facilitates communication between users
- Provides listing and booking management tools
- Offers informational resources about student accommodation
4.2 Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We do not guarantee:
- The quality, safety, or legality of listed accommodations
- The accuracy of listing information
- The conduct of any user
- The availability of accommodation
- Continuous, uninterrupted, or secure access to our services
5. Financial Terms and Liability
5.1 Payment Processing
All financial transactions occur directly between Students and Landlords
ResLinQ does not handle, process, or intermediate payments
We are not party to any rental agreements
Users are solely responsible for payment terms and conditions
5.2 No Financial Responsibility
ResLinQ is not responsible for any financial transactions between Students and Landlords
Users are solely responsible for their own financial obligations
We are not liable for any disputes arising from payment issues
Users acknowledge that ResLinQ bears no responsibility for refunds, deposits, or financial disputes
6. User Conduct and Responsibilities
6.1 Intellectual Property
All intellectual property rights, including trademarks, logos, and content, are owned by ResLinQ or its licensors
Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform
6.2 Prohibited Activities
Users shall not:
- Post false, misleading, or fraudulent information
- Harass, threaten, or intimidate other users
- Engage in any illegal activities
- Violate any applicable laws
- Attempt to circumvent the Platform's security
- Use the Platform for any commercial purposes not expressly authorized
- Reverse engineer, decompile, or disassemble any aspect of the Platform
6.3. Landlord Responsibilities
- Ensure accommodations meet minimum safety and habitability standards under South African rental law
- Respect tenant rights under the Rental Housing Act
- Address reported issues promptly and professionally
- Maintain accurate and up-to-date listing information
- Comply with all applicable housing and accommodation regulations
6.4 Content Guidelines
Users must ensure all content:
- Is accurate and truthful
- Does not infringe intellectual property rights
- Is not defamatory, obscene, or offensive
- Complies with all applicable laws
- Does not contain malicious code or viruses
6.5 Verification Responsibility
Users are solely responsible for:
- Verifying the identity of other users
- Inspecting properties before committing
- Reviewing and understanding rental agreements
- Ensuring compliance with applicable laws
- Conducting background checks if desired
6.6 User Content License
By posting content, you grant ResLinQ a worldwide, non-exclusive license to:
Display your content on the Platform
Use your content for Platform operations
Modify content for technical purposes
Distribute and promote your content in connection with the Platform
7. Limitation of Liability
7.1 Limitation of Liability
ResLinQ is not liable for any direct, indirect, incidental, consequential, or punitive damages
TO THE FULLEST EXTENT PERMITTED BY LAW, RESLINQ SHALL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES ARISING FROM:
- USER INTERACTIONS OR DISPUTES
- PROPERTY DAMAGE OR PERSONAL INJURY
- FINANCIAL LOSSES OR TRANSACTION DISPUTES
- UNAUTHORIZED ACCESS TO USER DATA
- PLATFORM DOWNTIME OR TECHNICAL ISSUES
7.2 Maximum Liability
IN NO EVENT SHALL RESLINQ'S TOTAL LIABILITY EXCEED THE AMOUNT OF R100 (ONE HUNDRED RAND) OR THE MINIMUM AMOUNT PERMITTED BY LAW.
7.3 Essential Purpose
You acknowledge that the limitations of liability in this section are an essential basis of the bargain and that ResLinQ would not provide the Platform without such limitations.
8. Privacy and Data Protection
8.1 Data Collection
We collect and process personal data in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA), including:
- Contact information
- Identity verification data
- Payment information (processed by third parties)
- Usage data and analytics
- Communication records
8.2 Data Security
While we implement security measures, we cannot guarantee absolute security of user data.
Users are responsible for maintaining the confidentiality of their account credentials.
We implement appropriate technical and organizational measures to protect personal information.
8.3 Data Sharing
We may share user data with:
- Service providers who assist in platform operations
- Legal authorities when required by law
- Other users as necessary for the accommodation matching process
9. Governing Law and Jurisdiction
These terms and conditions are governed by and construed in accordance with the laws of South Africa.
Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
The United Nations Convention on Contracts for the International Sale of Goods shall not apply.
10. Indemnification
You agree to indemnify, defend, and hold harmless ResLinQ, its directors, employees, and agents from and against all claims, losses, expenses, damages, and costs including:
- Your use of the Platform
- Your violation of these terms
- Your interaction with other users
- Any content you post
- Your violation of any laws
- Any claims brought by third parties arising from your use of the Platform
This indemnification obligation will survive the termination of your account or these Terms.
11. Dispute Resolution
11.1 User Disputes
Disputes between users must be resolved directly between the parties involved. ResLinQ is not obligated to mediate or participate in user disputes.
11.2 Governing Law
These terms shall be governed by and construed in accordance with the laws of South Africa.
11.3 Arbitration
Any disputes with ResLinQ shall be resolved through binding arbitration in South Africa in accordance with the Arbitration Act of South Africa.
You waive any right to participate in class actions or class-wide arbitration.
12. Property and Accommodation Specific Terms
12.1 No Property Verification
ResLinQ does not:
- Verify property conditions or safety
- Inspect accommodations
- Validate landlord credentials
- Ensure compliance with housing regulations
- Guarantee the accuracy of property listings
12.2 User Due Diligence
Users are solely responsible for:
- Property inspections
- Verifying landlord ownership/authority
- Checking compliance with local regulations
- Ensuring accommodation meets their needs
- Confirming all property details before commitment
12.3 Rental Agreements
All rental agreements are:
- Between Student and Landlord only
- Governed by their own terms
- Not involving ResLinQ in any capacity
- Subject to applicable rental housing laws
13. Safety and Security
13.1 Personal Safety
Users acknowledge that:
- They are responsible for their own safety
- They assume all risks when interacting with other users
- They should be aware of their surroundings
- They should take appropriate safety precautions
- ResLinQ does not conduct background checks
- ResLinQ does not verify the identity or credentials of users
13.2 Meeting Safety
When meeting other users, we recommend:
- Meeting in public places initially
- Informing friends or family of meetings
- Verifying identities thoroughly
- Conducting property viewings during daylight hours
- Trusting your instincts and leaving uncomfortable situations
14. Updates and Amendments
14.1 Changes to Terms
We reserve the right to modify these terms and conditions at any time at our sole discretion
Material changes will be communicated to users as required by law
14.2 Notification
We will notify users of material changes via:
- Platform notifications
- Email communications
- Posting on our website
14.3 Effect of Amendments
Amendments to these terms will take effect upon the date they are posted on the Platform
Your continued use of the Platform after changes constitutes acceptance of the revised terms
15. Termination
15.1 Termination by User
You may terminate your account at any time by contacting customer support or using account deletion features
15.2 Termination by ResLinQ
We may suspend or terminate your access to the Platform:
- For violation of these Terms
- For fraudulent or illegal activities
- If we discontinue the Platform
- For any other reason at our sole discretion
15.3 Effect of Termination
Upon termination:
- Your right to use the Platform immediately ceases
- You must cease all use of the Platform
- We may delete your account information
- Provisions that by their nature should survive will survive
16. Force Majeure and Miscellaneous
16.1 Force Majeure
ResLinQ shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:
- Natural disasters
- Government actions
- Internet outages
- Technical failures
- Acts of terrorism or war
- Labor disputes
16.2 Severability
If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
16.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
16.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights to any affiliate or successor.
17. Entire Agreement and No Agency Relationship
17.1 Entire Agreement
These terms constitute the entire agreement between you and ResLinQ regarding use of the Platform and supersede all prior agreements.
17.2 No Agency Relationship
No agency, partnership, joint venture, or employment relationship is created between ResLinQ and any user through use of the Platform.
ResLinQ is not acting as agent for any user in any capacity.

19. Additional Country-Specific Provisions

- Electronic Communications and Transactions Act
- Rental Housing Act
19.2 Rental Housing Act
Users are responsible for compliance with the Rental Housing Act and related regulations.
Landlords must provide tenants with written lease agreements that comply with the Act.
19.3 Tax Obligations
Users are responsible for their own tax obligations arising from transactions on the Platform.
Landlords are responsible for declaring rental income to SARS.
20. Acknowledgement

BY USING THE RESLINQ PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. YOU FURTHER ACKNOWLEDGE THAT RESLINQ ACTS SOLELY AS A PLATFORM PROVIDER AND BEARS NO RESPONSIBILITY FOR USER INTERACTIONS, FINANCIAL TRANSACTIONS, OR ACCOMMODATION ARRANGEMENTS.

These terms contain important limitations on your rights and remedies, including limitations on ResLinQ's liability and your agreement to indemnify ResLinQ. Please read them carefully.
